03. There are many courses of action available to your client, including:
Creditors Voluntary Liquidations (CVL)
If directors and/or shareholders want to put a company into liquidation because it is insolvent.
Members Voluntary Liquidations (MVL)
If directors no longer wish the company to trade ~ although it is solvent.
Company Voluntary Arrangement (CVA)
Where a legal agreement is reached between a company and its creditors, whereby the company repays a set amount ~ typically lower than the actual total debt.
Pre Pack Administration ('Phoenix')
Where directors of an insolvent company are able to start a new business after buying the assets of a failing business. New funds can be used to set up a new company and acquire the assets of the old. Any liabilities of the old business (e.g. outstanding debts) stay with the old company ~ which is usually liquidated.
